Updated TOS?

There has been a lot of confusion about some of the items in the Terms Of Service. It is agreed that it needs an updating. Watch for an announcement coming soon regarding rule updates and be responsible for their knowing their contents.

I see there has been a lot of commotion and would like to help. I worked on a new TOS for the site a while back and would like to know if you all would accept it? I purely did it for the site and because of the outdated one was in desperate need of an update. I would like to think that it covers every aspect of the game, but there is always an new issue or issues that emerges . I don't know if you guys are currently working on one or what, but I have put my time in to complete a new TOS. I will post it for review.

•General

By accessing or using this site you warrant that you fully understand and agree to be bound by these Terms Of Service. Fire Fight reserves the right at its full discretion to modify the Terms Of Service at any time. Such modification enters into force when published on this page and we will indicate the date of last revision in the News section. Your continued use after such modification is valid as consent thereto. If you do not accept to abide by the Terms Of Service you should not access our website or use our Service. Do check our website's rules and regulations regularly to verify whether the Terms Of Service have been modified, as ignorance will not be accepted as an excuse!

•The Game/ Service

Fire Fight does not guarantee that you will be able to login to the game and / or gain access to all parts of the game. Certain parts may be unavailable to players due to they're browser version, firewall, security settings, or a problem occurring within the game. You understand that the Service may continuously evolve over time. Fire Fight reserves the right to modify the Service at any time and without notice. Some parts of the Service are available without cost. Use of the parts of the Service that are not available for free, will require pre-payment.

Any tax, duty or fee due in connection with your use of the Service will be your sole responsibility.

•Accounts and Membership

When you become a Fire Fight member, your personal account is created which will contain basic account information including username and password. You are responsible for your username and password and should never give out your password to anyone else. You may not select or use an identity of another person with the intent to impersonate that person. You must use a valid e-mail address and Fire Fight reserves the right to test and to verify this at any time.

Fire Fight reserves the right to, at its own discretion and without explanation necessary, block or delete an account for any reason it deems necessary and without refund, in particular, but not limited to the situation where a violation of these Terms Of Service has occurred or is reasonably suspected.

All accounts, including their resources, units, etc. are virtual objects of the Service. You do not obtain ownership or any other rights to the account. All rights are reserved by Fire Fight. No rights, in particular exploitative rights, are assigned to the user.

•Prohibition of exploitation

Without written permission of Fire Fight, it is prohibited to agree with third parties upon the transfer, the utilization or the provision of accounts or access data. In particular, it is prohibited to sell account resources, or to make any other profit by leaving accounts or resources to third parties. The same applies to selling access data, rights of utilization as well as any other attempt to evade this regulation. Violations of these or other rights of Fire Fight, in particular copyrights, will be reported to authorities and prosecuted.

Exceptions

It is not prohibited to transfer accounts finally and free of charge, as well as the internal "trading" of resources, if and as far as allowed by the Game Rules.

•Use of the Service/ Code of conduct

Fire Fight provides a platform that allows you to communicate with other users. You bear the full responsibility for such communication. Fire Fight does not control the content and takes no responsibility for it.

Your information and your activities on the website must not: be false, incorrect or misleading; or violate confidentiality or any other rights; infringe on a third party's copyright, trademark, trade secret, patent or any other right or publishing right; be fraudulent or violate applicable laws and ordinances.

Threatening, abusive, disparaging, pornographic, offensive, hateful, racially, ethnically or otherwise objectionable content is not permitted and are not within the responsibility of Fire Fight. Violations could lead to blockage and deletion from the Service and the membership.

•Prohibited actions - Manipulative actions

You must not use actions, mechanism or software in conjunction with the website(s) which could interfere with the function and development of the Service. You are not permitted to take actions, which cause an unacceptable or excessive strain of technical capacities. You are not permitted to block, overwrite, or modify content which was generated by Fire Fight.

•Prohibited programs

It is prohibited to load the Service with any other programs than web browsers. Such other programs are in particular so called "Bots" as well as other tools that simulate, replace or supplement the web interface. The same applies to scripts and completely or partially automated programs that provide advantages towards other users. Auto-refresh-functions and other integrated mechanisms of the web browser are included, as long as those are automated actions. The usage of actions which disable advertisements is prohibited. It is inconsequential if the advertisement is blocked on purpose or is generally blocked through a pop-up-blocker, text based browser or other similar function. The only exemptions from this are those which have explicitly obtained permission from Fire Fight.

•Direct log-ins

The log-in into an account is permitted directly from the start page on the website http://www.firefightff.com/login.php only. Automated opening of an account, no matter if displaying the start page or not, is prohibited.

•Game Rules

As a condition of use, you agree to obey to the Game Rules at all times. Full particulars are contained in the Game Rules. The Game Rules can be found under the RULES section on the start page of the website. The Game Rules may vary from time to time due to the nature of the Game. The Game evolves over time and makes some Game Rules obsolete and new Game Rules come into effect.

•Bugs

To use a bug or other error in the code or the system is considered as cheating and therefore prohibited. If you discover such an error you should report it to the administrator and staff immediately. You can also report to reefergamesupport@firefightff.com (support@gamename.com).

•Virus or corrupted data

You must not post or transmit content that contains virus or corrupted data or any unsolicited advertising, promotional materials, “junk mail”, “spam”, “chain letters, “pyramid schemes” or similar.

•Availability of the Service

You cannot claim a right to enter or to use the Service. Fire Fight does not and cannot guarantee that Service will be uninterrupted or error free. The Service is delivered "AS IS" without any warranties. Use of the Service is at your sole risk.

•Payment

Some parts of the Service are available without cost. The Service that is not can only be used against full payment in advance. You will be charged for the Service in accordance with what is set out on the website.

If the necessary payment cannot be collected you will not access such parts of the Service that require pre-payment.

If you're caught breaking any of the above Terms Of Service and / or rules, your account could be banned and you won't be able to register again. Being a member of staff or a donator to the game does not make you exempt from these rules.

One thing though(maybe i'm getting lost in the lawyer speak):

Most web browsers come pre-packed with popup blockers now. Seems like an unfair rule for those that do not fully understand the browser they are using. Just a thought.
